Excise tax is an indirect tax applied to specific goods considered harmful to health or the environment. It’s governed by Federal Decree‑Law No. (7) of 2017 and enforced by the Federal Tax Authority (FTA). Excise tax aims to discourage consumption of such products and raise revenue for public initiatives.

The main excisable goods include tobacco products, energy drinks, electronic smoking devices, and sweetened drinks. Under the updated regime effective 1 January 2026, sugary beverages are taxed based on sugar content rather than a flat rate: High sugar drinks (≥8g/100ml): AED 1.09 per litre; Moderate sugar drinks (5g–<8g/100ml): AED 0.79 per litre; Low sugar drinks (<5g/100ml): AED 0 per litre; Artificial sweeteners only (0g sugar): AED 0 per litre. Other excisable goods (tobacco, energy drinks, etc.) continue to be taxed at high percentage rates as defined under Cabinet decisions.

Any business that imports, produces, stores, or releases excisable goods in the UAE must complete excise tax registration in the UAE with the FTA. This includes manufacturers, importers, and warehouse operators. Registration is done online via the FTA’s portal and is mandatory regardless of the volume of goods.

For most excisable products, the tax is calculated based on either a fixed volumetric model (e.g., AED per litre for sweetened drinks based on sugar content) or the established percentage/price model for other goods. The taxable amount is determined using the higher of the FTA’s published excise price or the designated retail sales price.

Until 31 December 2025, a flat rate (often 50%) applied to sweetened drinks regardless of sugar content. From 1 January 2026, the UAE switched to a tiered, volumetric tax system that links excise tax to sugar/sweetener content per litre of beverage. This encourages lower‑sugar formulations and reflects a more precise public health‑focused approach.

Some products are exempt or zero‑rated even if they might otherwise be excisable, provided they meet strict criteria. Examples include 100 % natural juices with no added sugar, baby formula and foods, dietary/medical beverages, and dairy products. Even if the excise rate is zero, compliance (e.g., testing, registration) is still required.

After registering, businesses must file excise tax returns in Dubai, UAE and pay any due tax according to specified tax periods, often monthly. The return includes details of excisable goods imported, produced, or released into the UAE. Returns are submitted through the FTA’s EmaraTax system.

Non‑compliance can lead to significant penalties: late registration may attract fines of around AED 10,000; late returns can incur AED 1,000 for first offences and higher for repeated delays; and failure to pay tax on time might incur percentage‑based charges on the unpaid tax amount.

Goods held in designated zones (e.g., JAFZA, DMCC) may not immediately incur excise tax until released to the UAE market. If goods are exported or remain within the designated zone under compliant conditions, businesses might qualify for an excise tax refund or deferment upon correct documentation.

Businesses must maintain accurate records and documentation supporting import/production, sugar content lab tests for beverages, excise tax returns, and any refund claims. Laboratory certifications are essential for sugar categorisation under the new regime.

Excise tax is separate from VAT. Businesses dealing with excisable goods may still be VAT‑registered and must comply with both frameworks independently. Excise tax is levied at the production/import stage on specific goods, while VAT applies broadly at a standard rate (typically 5%) on goods and services.
